Town Planning Scheme No. 1 – Amendment No. 73

Notice is hereby given that the Local Government of the Town of Victoria Park has resolved to initiate the above Town Planning Scheme Amendment to modify Town Planning Scheme No. 1 by designating the Residential Character Study Area as a Special Control Area, amending the Precinct Plans accordingly and inserting relevant provisions in to the Scheme Text. 

Amendment No. 73 to the Town of Victoria Park Town Planning Scheme No. 1 (the Scheme) proposes to:

  • Designate the Residential Character Study Area as a Special Control Area under the Scheme to be known as the Residential Character Special Control Area;
  • Modify Precinct Plans P5, P6, P10 and P12 to identify the location of the Special Control Area within the Scheme Area; and
  • Insert provisions relating to the Special Control Area in Schedule 7 of the Scheme Text including:
  • The need for development approval to demolish ‘original dwellings’;
  • The need for development approval for building works that are not otherwise exempt from approval; and
  • Development to comply with the provisions of a Local Planning Policy adopted for the Residential Character Special Control Area; and
  • The ability for Conservation Notices to be served to owners of ‘original dwellings’ who do not maintain their properties. 

Please refer to the below plan depicting the location of the Residential Character Special Control Area and those dwellings which are considered an ‘original dwelling’.  Should you require confirmation of whether your dwelling is an ‘original dwelling’ please contact Council’s Urban Planning Business Unit on 9311 8111.

The proposed Scheme Amendment documents are available for inspection at the Town of Victoria Park Administration Centre, 99 Shepperton Road, Victoria Park, and the Victoria Park Library, 27 Sussex Street, East Victoria Park, during business hours. The proposed Scheme Amendment document, maps and provisions can also be downloaded via the link under 'Related Information'. 

Additionally, two Community Information Sessions are to be held as per the details below. These will provide an overview of the amendment and be a good opportunity to ask any questions that you may have regarding the proposal.

Submissions

This proposed Amendment is available for inspection and public comment, and it should not be construed that final approval will be granted.  Your written comments are welcome and will be considered by Council prior to a recommendation being made to either proceed, modify or abandon the proposal. 

Submissions on the Town Planning Scheme Amendment must be lodged in writing by 5pm Tuesday 21 March 2017, by one of the following:
