Noise
Environmental Health Officers are authorised to enforce the noise legislation under the Environmental Protection Act. It is an offence to create excessive or unreasonable noise and offenders can be issued with infringement notices and/or prosecuted in a court of law.
- If you are experiencing a problem with ongoing noise, the town recommends:
- If safe do to so approach the person making the noise to discuss a possible resolution
- If your approach does not succeed in resolving the problem and the noise is causing a problem on an ongoing basis submit a complaint to the Town
- Keep a record of the days and times that the noise is a problem
- If the noise occurs after-hours, report it to the Police 131444. The Town uses the incident reports to take further action against the person making the noise
Noise from aircraft, trains and vehicles operating on public road, rail and air systems is exempt from complying with the Environmental Protection (Noise) Regulations 1997.
Specified Equipment
Equipment that requires the presence of an operator (eg, lawn mowers and power tools) is permitted to be used for up to two hours per day
- 7.00am and 7.00pm Monday to Saturday
- 9.00am to 7.00pm on Sunday and public holidays
Musical Instruments
Musical instruments are permitted to be used in a reasonable manner for up to one hour per day;
- 7.00am and 7.00pm Monday to Saturday
- 9.00 a.m. to 7.00 p.m. on Sundays or public holidays
Construction & Demolition Work
Noise resulting from construction, demolition or earthwork activities must not be emitted before 7.00am or after 7.00pm Monday to Saturday and not at all on Sundays or public holidays. This type of noise includes:
- Hammering
- Cement mixers
- Power tools and equipment
Builders can be on site outside of these hours, but are not allowed to produce any noise. Radios that are used on site are not permitted to produce excessive noise at any time.
