5.2024.460.1 - 88 Basinghall Street, East Victoria Park


The Town has received a development application seeking retrospective approval for existing sitework comprising fill and retaining walls along the side and rear lot boundaries at the above-mentioned property.

In accordance with Local Planning Policy 37 ‘Community Consultation on Planning Proposals’, you are invited to comment on the following:

  • Fill and Retaining behind the Street Setback Line – The site works along the north-eastern, south-western and south-eastern boundaries do not meet the deemed-to-comply requirements of Residential Design Codes Volume 1 (R-Codes), Part B, Clause 5.3.7 C7.2 as follows:
    • North-eastern side lot boundary (adjoining 86A Basinghall St; Lot 8) – The application proposes stepped limestone retaining walls with a maximum height of 1.67 metres above the natural ground level (NGL), which partially encroaches into the adjoining Lot 8 in lieu of being setback a minimum distance of 2.0 metres from the lot boundary.
    • South-western side lot boundary (adjoining 88A Basinghal St; Lot 91) - The application proposes stepped limestone retaining walls with a maximum height of 0.68 metres above the NGL, which partially encroaches into the adjoining Lot 91 in lieu of being setback a minimum distance of 1.0 metre from the lot boundary.
    • South-eastern rear lot boundary (adjoining 95 Canterbury Tce; Lot 63) - The application proposes timber panel-and-post retaining with a maximum height of 1.28 metres above the NGL, which encroaches into the adjoining Lot 63 in lieu of being setback a minimum distance of 1.5 metres from the lot boundary.

Please note that the abovementioned matter/s will be considered based on the merits of the case, and with regard to the relevant design principles of the R-Codes and any comments received from affected landowner(s) and occupier(s).
