The Town has received a development application for permanent change of use to Tavern and Brewery at the above-mentioned property.
A temporary development approval for a Tavern and Light Industry (Brewery) was granted by the Town on 10 October 2017. An amended development approval was granted on 15 March 2022. The amended approval extended the Tavern and Brewery uses for a period valid until 1 July 2033.
The Town’s new Local Planning Scheme No. 2 was gazetted in December 2024, which allows for the Tavern and Brewery land uses to be contemplated on a permanent basis. Subsequently, the landowner has lodged an application with the Town seeking a permanent approval to the subject site, allowing operations to continue beyond 2033.
In accordance with Local Planning Policy 37 – Community Consultation on Planning Proposals (LPP37), you are invited to comment on the following:
- Proposed Use – Both the Tavern and Brewery uses are classified as an “A” (discretionary) land use within the subject Mixed Use zone under Local Planning Scheme No. 2 (LPS2).
The Tavern and Brewery uses are defined under LPS2 Part 6 Division 2 as follows:
“Tavern – means premises the subject of a tavern licence granted under the Liquor Control Act 1988.”
“Brewery – means premises the subject of a producer’s licence authorising the production of beer, cider or spirits granted under the Liquor Control Act 1988.”
An “A” use means that the use is not permitted unless the local government has exercised its discretion by granting development approval after advertising the application.
Please note that the above-mentioned matter/s will be considered based on the merits of the case, and with regard to the relevant provisions of the Town's Local Planning Scheme No. 2 and local planning policies (such as Local Planning Policy 40) along with any comments received from landowner(s) and occupier(s) of surrounding properties.
