5.2026.21.1 - 40A Lichfield Street, Victoria Park


The Town has received a development application for a Change of Use from Grouped Dwelling to Unhosted Short-Term Rental Accommodation (STRA) at the above-mentioned property.  The proposed Unhosted Short-Term Rental Accommodation will provide accommodation a maximum of six (6) guests at any one time within the existing three bed-room and two-bathroom dwelling, which has two on-site car parking spaces.

In accordance with the Town’s Local Planning Policy 37 – Community Consultation on Planning Proposals, you are invited to comment on the following:

  • Proposed Use - An Unhosted Short-Term Rental Accommodation is classified as an “A” land use within the Residential zone under Local Planning Scheme No. 2 (LPS2)

In accordance with LPS2 Clause 18 (2), an “A” land use means that the use is not permitted unless the local government has exercised its discretion by granting development approval after advertising the application in accordance with clause 64 of the deemed provisions.  

The Town will exercise its discretion by considering the relevant requirements of the local planning framework, including but not limited to the provisions of the Town's Local Planning Policy 31 - Serviced Apartments and Residential Buildings including Short Term Accommodation.

It is noted that the decision-maker will take into account the comments received, however, are not obliged to support these views. The above matter(s) will be considered based on the merits of the case, and with regard to the relevant design principles and any comments received from nearby affected landowner(s) and occupier(s).
