The Town has received a development application for a Single House at the above-mentioned property. In accordance with Local Planning Policy 37 – Community Consultation on Planning Proposals, you are invited to comment on the following: 

  • Maximum Height of Boundary Wall – The Residential Design Codes prescribes the height of boundary walls. The application proposes variations to the setback of the following wall:  
    • Northern boundary with a maximum height of 3.8 metres above natural ground level in lieu of a maximum height of 3.5 metres as permitted under the Residential Design Codes.

  • Boundary Setbacks – The Residential Design Codes prescribes the minimum setback distance of buildings from boundaries other than the street. 
    • Garage wall – 1 metre required; 0 metres proposed.
  • Site works - The Residential Design Codes prescribes the minimum setback distance of retaining along boundaries and within the lot. The application proposes variations to the setback below:

  • Northern retaining wall: 1m required, 0m proposed (post and rail retaining on boundary)
  • Southern retaining on boundary: 1.5m required, 0m proposed (post and rail retaining on boundary)

  • Visual privacy – The Residential Design Codes prescribes minimum ‘cone of vision’ setbacks for major openings and active habitable spaces (such as an alfresco, balcony or patio) to minimise direct overlooking onto adjoining neighbours.
    • Northern boundary: Guest bedroom – 4.5m required; 2m proposed
    • Southern boundary: Study – 4.5m required; 3.6m proposed

  • setting back the first floor from the side boundary;  
  • providing higher or opaque and fixed windows; and/or  
  • screen devices (including landscaping, fencing, obscure glazing, timber screens, external blinds, window hoods and shutters)
