5.2025.85.1 - 40 Gresham Street, Victoria Park


The Town has received a development application for Four Grouped Dwellings at the above-mentioned property.

 

In accordance with Local Planning Policy 37 – Community Consultation on Planning Proposals, you are invited to comment on the following:

 

  • Primary Street Setback – Council’s Local Planning Policy – Streetscape requires a minimum street setback of 3.0 metres from Gresham Street with an average setback of not less than 6.0 metres. The application proposes a setback to Gresham Street of 3.0 metres minimum and 6.0 metres average.

 

  • Boundary Setbacks – The Residential Design Codes prescribes the minimum setback distance of buildings from boundaries other than the street. The application proposes variations to the setback of the following walls:

 

    • Upper Floor wall from Bed 1 to Bed 4 etc of Unit 4 - 3 metre setback required where wall length exceeds 14 metres; 1.5m metre setback proposed to the common boundary with 77A Teague Street with wall length of 15.2 metres.

 

The above-mentioned matters will be considered based on the merits of the case, and with regard to the relevant design principles and any comments received from nearby affected landowner(s) and occupier(s).

·         contribute to the desired streetscape;

·         provide adequate privacy for open space for dwellings;

·         allow safety clearances for easements for essential service corridors;

·         promote the creation of new streetscape environments through the use of existing rights-of-ways; and

·         protect residential amenity from disturbance from non-residential development abutting a right-of-way and provide safety of residential development add surveillance of the right-of-way.

P3.4.1 Lot boundary setbacks reinforce the location’s streetscape character and are consistent with the existing or desired built form local character.

 

P3.4.2 The setback of development from lot boundaries provides a transition between sites with different land uses or intensity of development.

 

P3.4.3 Buildings are set back from lot boundaries or adjacent buildings on the same lot to:

i.              provide adequate solar access and natural ventilation to the building and open spaces on the site and adjoining properties; and

ii.             address the potential for overlooking and resultant loss of privacy on adjoining properties.
