The Town has received a development application for Additions / Alterations to a Grouped Dwelling at the above-mentioned property.

In accordance with Local Planning Policy 37 – Community Consultation on Planning Proposals, you are invited to comment on the following:

  • Boundary Setbacks – The Residential Design Codes prescribes the minimum setback distance of buildings from boundaries other than the street. The application proposes variations to the setback of the following walls:
    • Patio columns and roof are proposed to be setback nil to the rear (northern) boundary, whilst a 1.5 metre setback is required.
    • Patio roof is proposed to be setback 0.5m to the side (eastern) boundary and patio columns are proposed to be setback 0.6m to the side (eastern) boundary, whilst a 1 metre setback is required.
  • Visual Privacy – The Residential Design Codes prescribes minimum setback distances for unscreened major openings from boundaries in order to achieve a reasonable level of privacy. The application proposes variations as follows:
    • Raised outdoor living area to northern (rear) boundary – 7.5 metres required; 1.3 metres proposed.
    • Raised outdoor living area to eastern (side) boundary – 7.5 metres required; 5.3 metres proposed.

Please note, to help mitigate direct overlooking the homeowners are proposing to construct up to 2.9 metre high brick boundary walls.

Please note the abovementioned matter/s will be considered based on the merits of the case, and with regard to the relevant design principles of the R-Codes and any comments received from directly adjoining owners and occupiers.

3.4 Lot boundary setbacks

P3.4.1 Lot boundary setbacks reinforce the location’s streetscape character and are consistent with the existing or desired built form local character.  

P3.4.2 The setback of development from lot boundaries provides a transition between sites with different land uses or intensity of development.  

P3.4.3 Buildings are set back from lot boundaries or adjacent buildings on the same lot to:  

  1. provide adequate solar access and natural ventilation to the building and open spaces on the site and adjoining properties; and  
  2. address the potential for overlooking and resultant loss of privacy on adjoining properties.

    3.10 Visual privacy  

    Relevant design principle(s) 

    P3.10.1 Direct overlooking of major openings and active habitable spaces of adjacent dwellings and adjoining properties minimised through:  

    i. building siting, layout and design; 

    ii. design and location of major openings;  

    iii. landscape screening of outdoor active habitable spaces; and/or  

    iv. design and location of screening devices.  

    P3.10.2 Adequate visual privacy achieved through appropriate interfaces between dwellings and adjoining properties including measures such as:  

    i. offsetting the location of ground and first floor windows so that viewing is oblique rather than direct; 

     ii. building boundary walls where appropriate;  

    iii. setting back the upper storeys from the lot boundary;  

    iv. providing higher or lower windows, or windows with obscure glazing; and/or  

    v. screening (including landscaping, fencing, timber screens, external blinds, window hoods and shutters).  

     

    P3.10.3 Visual privacy strategies maintain amenity of habitable rooms and active habitable space with regard to solar access, natural ventilation and external outlook both within the development and for adjoining properties.
