5.2024.260.1 - 118 Hordern Street, Victoria Park (Closed)


The Town has received a development application for Additions/Alterations to a Single House at the above-mentioned property. This includes modifications to the Outbuilding (Shed) and modification to the Upper Floor Bedroom major opening (window).

In accordance with Local Planning Policy 37 – Community Consultation on Planning Proposals, you are invited to comment on the following:

  • Visual Privacy – The Residential Design Codes prescribes minimum setback distances for bedrooms from boundaries in order to achieve a reasonable level of privacy. The application proposes variations as follows:
    • First floor bedroom window to the northwestern boundary - 3.0 metre setback is required; 2.5 metres setback proposed to the northwestern lot boundary.

 

  • Visual Privacy – The Residential Design Codes prescribes minimum setback distances for raised outdoor living areas from boundaries in order to achieve a reasonable level of privacy. The application proposes variations as follows:
    • Raised decking adjacent to northeastern lot boundary – 6.0 metre setback is required; 3.4 metres setback proposed to the northwestern lot boundary.

Please note the extent of the visual encroachment has been annotated as being 6.0 metres and 7.5 metres required, respectfully. The submitted plans have been correctly reannotated to the prescribed distance above mentioned, as in accordance with the Residential Design Codes (R-Codes) Volume 1.

3.10 Visual privacy  

Relevant design principle(s) 

P3.10.1 Direct overlooking of major openings and active habitable spaces of adjacent dwellings and adjoining properties minimised through:  

i. building siting, layout and design; 

ii. design and location of major openings;  

iii. landscape screening of outdoor active habitable spaces; and/or  

iv. design and location of screening devices.  

 

P3.10.2 Adequate visual privacy achieved through appropriate interfaces between dwellings and adjoining properties including measures such as:  

i. offsetting the location of ground and first floor windows so that viewing is oblique rather than direct; 

 ii. building boundary walls where appropriate;  

iii. setting back the upper storeys from the lot boundary;  

iv. providing higher or lower windows, or windows with obscure glazing; and/or  

v. screening (including landscaping, fencing, timber screens, external blinds, window hoods and shutters).  

 

P3.10.3 Visual privacy strategies maintain amenity of habitable rooms and active habitable space with regard to solar access, natural ventilation and external outlook both within the development and for adjoining properties. 

Please note that the above mentioned matters will be considered based on the merits of the case, and with regard to the relevant design principles and any comments received from nearby affected landowner(s) and occupier(s).
