5.2025.336.1 - Development Application - Single House - No. 222A Rutland Avenue CARLISLE (Closed)


The Town has received a development application for a Single House at the above-mentioned property.

In accordance with Local Planning Policy 37 – Community Consultation on Planning Proposals, you are invited to comment on the following:

  • Primary Street Setback – Council’s Local Planning Policy – Streetscape requires a minimum street setback of 3.0 metres from Rutland Avenue front boundary with an average setback of not less than 6.0 metres. The application proposes a setback to Rutland Avenue front boundary of 5 metres minimum and 5.5 metres average.
  • Boundary Wall Setback from Primary Street – Council’s Local Planning Policy – Streetscape requires a minimum street setback of 6.0 metres from Rutland Avenue front boundary. The proposed boundary wall setback from the Rutland Avenue front boundary at the N/W boundary is 5 metres and 5.4m at the S/E boundary.
  • Boundary Setbacks – The Residential Design Codes prescribes the minimum setback distance of buildings from boundaries other than the street. The application proposes variations to the setback of the following walls:
    • The wall to Master/ensuite – 1.5 metres required; 1.1 metres proposed to southern/eastern boundary.
  •  Length of Boundary Wall – The combined length of the boundary walls to the southern/eastern boundary is proposed to have a length of 18.2 metres. The Residential Design Codes permits a boundary wall of a maximum length of 9.4 metres as permitted under the Residential Design Codes.

Please note the abovementioned matters will be considered based on the merits of the case, and with regard to the relevant design principles of the R-Codes and any comments received from directly adjoining owners and occupiers.

  • contribute to the desired streetscape;  
  • provide adequate privacy for open space for dwellings;  
  • allow safety clearances for easements for essential service corridors;  
  • are consistent with the rhythm and scale of development in the street;  
  • promote the creation of new streetscape environments through the use of existing rights-of-ways; and   
  • protect residential amenity from disturbance from non-residential development abutting a right-of-way and provide safety of residential development add surveillance of the right-of-way.

  • does not compromise the design principle contained in clause

  • ensures sunlight to major openings to habitable rooms and outdoor living areas for adjoining properties is not restricted; and  
  • positively contributes to the prevailing or future development context and streetscape as outlined in the local planning framework.
