5.2026.175.1 - 101 Star Street CARLISLE


The Town has received a development application for Three Grouped Dwellings at the above-mentioned property. In accordance with Local Planning Policy 37 – Community Consultation on Planning Proposals, you are invited to comment on the following:

 

  • Primary Street Setback – Council’s Local Planning Policy – Streetscape requires a minimum street setback of 3.0 metres from Star Street with an average setback of not less than 6.0 metres. The application proposes a setback to Star Street of 3.0 metres minimum and 5.73 metres average.

 

  • Maximum Height of Boundary Wall – Two boundary walls to the north-west boundary adjacent 99 Star Street with a maximum height of 3.6 metres above natural ground level in lieu of a maximum height of 3.5 metres as permitted under the Residential Design Codes.

 

  • Fill and Retaining behind Street Setback Line - A retaining wall is proposed to be constructed along the north-western and south-western common boundaries with 99 Star Street and 102C Mars Street. The retaining wall is proposed to have a varying height of between 0.0 metres and 1.2 metres above natural ground level. The Residential Design Codes permit filling and associated retaining walls behind the street setback line and within 1.0 metre of a common boundary up to a maximum height of 1.0 metre above natural ground level.

 

  • Fill within Street Setback Area – The application proposes fill and associated retaining wall(s) between the street alignment and the dwelling with a varying height of between 0 metres and 0.6 metres above the natural ground level. The Residential Design Codes permit filling or excavation within 3 metres of the street alignment or between the street and the building (whichever is the lesser) where it does not exceed 500mm from the natural ground level.

  • provide adequate privacy for open space for dwellings;  
  • allow safety clearances for easements for essential service corridors;

  • promote the creation of new streetscape environments through the use of existing rights-of-ways; and   
  • protect residential amenity from disturbance from non-residential development abutting a right-of-way and provide safety of residential development add surveillance of the right-of-way.

  • does not compromise the design principle contained in clause

  • ensures sunlight to major openings to habitable rooms and outdoor living areas for adjoining properties is not restricted; and  
  • positively contributes to the prevailing or future development context and streetscape as outlined in the local planning framework.
