The Town has received a development application for five single storey Grouped Dwellings at the above-mentioned property.

 

In accordance with Local Planning Policy 37 – Community Consultation on Planning Proposals, you are invited to comment on the following:

 

  • Local Planning Policy 25 – Streetscape: Clause 1 - Setback of Buildings Generally (Secondary Street Setback) – Council’s Local Planning Policy – Streetscape requires a minimum secondary street setback for lot 1 of 3.0 metres from Carnarvon Street. Lot 1 proposes a reduced setback of 1.56 metres - 2.76 metres to Carnarvon Street.

 

  • Local Planning Policy 25 – Streetscape: Clause 2 – Setbacks of Garages and Carports – Council’s Local Planning Policy – Streetscape requires a minimum street setback of 6.0 metres from Dane Street for garages with boundary walls. Lot 1 comprises a garage with a boundary wall setback 5.4 metres to Dane Street.

 

  • Residential Design Codes Volume 1 (Part C): Part 2.3 - Parking (Visitor parking) One (1) visitor car bay is required to be provided for the development, as five (5) grouped dwellings are proposed. The application proposes nil visitor car bays.

 

  • Residential Design Codes Volume 1 (Part C): Part 3.4 - Lot boundary setbacks (boundary wall) – Both lots 1 and 2 comprise an adjoining boundary wall within the front setback area to Dane Street. Both walls are located 5.4 metres from the Dane Street lot boundary, in lieu of 6 metres.

 

Please note that the above mentioned matters will be considered based on the merits of the case, and with regard to the relevant design principles and any comments received from nearby affected landowner(s) and occupier(s).

  • contribute to the desired streetscape; 
  • provide adequate privacy for open space for dwellings; 
  • allow safety clearances for easements for essential service corridors; 
  • are consistent with the rhythm and scale of development in the street; 
  • promote the creation of new streetscape environments through the use of existing rights-of-ways; and  
  • protect residential amenity from disturbance from non-residential development abutting a right-of-way and provide safety of residential development add surveillance of the right-of-way.

P1. The setting back of carports and garages so as not to detract from the streetscape or appearance of dwellings, or obstruct views of the dwelling from the street and vice versa. 

 

P2. Garages which do not dominate the visual appearance of the lot having regard to the width of the lot and building frontage, the location of the upper floor relative to the garage, and the general design merit.

P2.3.1 Siting and the extent of parking does not dominate the development or streetscape and responds to the context and local character by:  

i. supporting the efficient use of the site; and  

ii. minimising the extent of paving for parking and vehicle access.  

 

P2.3.2 Adequate parking is provided for various modes of transport, including bicycles, motorcycles, scooters and cars, that has regard to the following considerations: 

i. the proximity of the proposed development to public transport, activity centres, areas of amenity and other facilities; ii. the type, size and number of dwellings; and  

iii. the availability of on-street and other offstreet parking.  

 

P2.3.3 Parking spaces are designed for flexibility and adaptability having regard for:  

i. the needs of occupants, including consideration of universally accessible parking spaces; and  

ii. the ability to use the space for alternative purposes.

3.4 Lot boundary setbacks (Boundary walls) 

Relevant design principle(s) 

P3.4.1 Lot boundary setbacks reinforce the location’s streetscape character and are consistent with the existing or desired built form local character.  

 

P3.4.2 The setback of development from lot boundaries provides a transition between sites with different land uses or intensity of development.  

 

P3.4.3 Buildings are set back from lot boundaries or adjacent buildings on the same lot to:  

  1. provide adequate solar access and natural ventilation to the building and open spaces on the site and adjoining properties; and  
  1. address the potential for overlooking and resultant loss of privacy on adjoining properties. 

 

P3.4.4 Buildings are built up to lot boundaries where this:  

i.           makes more effective use of space for primary garden areas and/or private open space; 

ii.         maintains adequate solar access to major openings and private open space of adjoining properties; and  

iii.        contributes positively to the prevailing or future development context and streetscape as outlined in the local planning framework.
